A Detroit police officer and the mother of his 3-year-old son face charges after the child brought a loaded gun to a Canton daycare.
Brandon John Ely, 28, was charged with one count of fourth-degree child abuse, a misdemeanor carrying up to one year. Rabab Ibrahim Al Zayad, 27, was charged with one count of unsafe storage of a firearm, a misdemeanor carrying up to 93 days, according to the Detroit News.
Both were arraigned Thursday, Oct. 1, in Plymouth's 35th District Court before Judge Joe Barone. Their attorney, Colemon Potts, waived the formal reading of charges and entered not guilty pleas.
As we reported Sept. 29, one parent was arrested after the incident at Children's World Early Learning Center, 7437 Sheldon Road in Canton Township. At the time, police had not identified either parent or the department employing the officer-parent. Prosecutors have since charged both parents.
Prosecutors allege the child found an unsecured firearm in a backpack stored in the classroom. The gun was passed to other students before a teacher intervened. No one was injured.
Canton police said they have video of the toddler pulling the weapon from the backpack. FOX 2 reported the footage shows the gun still holstered when the child took it out.
Ely is a Detroit police officer. The Detroit Police Department said he has been placed on administrative duty with no-gun status while it reviews the matter, according to CBS Detroit. It has not been confirmed whether the firearm found at the daycare belongs to Ely. Authorities confirmed it was not a service weapon.
During the arraignment, CBS Detroit reported, it was revealed that Ely owns nine firearms at his home. Judge Barone ordered that neither defendant may possess or own any firearms and that neither may go to the daycare. Judge Barone set a $10,000 personal bond for each defendant.
Wayne County Prosecutor Kym Worthy said the charges reflect what her office can prove beyond a reasonable doubt. "It is very unsettling to think about what may have happened in this case," Worthy said. "We are thankful that there was no loss of life at this daycare center."
Canton Police Chief Joseph Bialy praised the daycare's protocols and the instructor who intervened. On Sept. 28, when the incident first came to light, Bialy told ClickOnDetroit he believed the staff's response "kept everybody safe and avoided a tragedy."
Children's World said in a statement that it has added safety measures, including searching bags. The family is no longer enrolled at the center, according to parents who spoke to WXYZ.
The next pretrial date is Oct. 30.
